 An updated version of the FAQ related to the application of Stage V Regulation – Regulation (EU) 2016/1628 on gaseous and particulate pollutant emission limits for mobile machinery – has just been released. This version is intended to take into account the important regulatory and political changes in the European Union.

In practice, the modifications involve:

  • The new amendment (EU) 2021/1168 to Regulation 2016/1628 providing longer implementation dates for the production and the placing on the market of transition vehicles with an engine power between 56 kW and 130 kW. Other power ranges were already covered through Regulation (EU) 2020/1040.
  • The publication of Regulation (EU) 2021/1398, which amends the Stage V technical requirements set in the Delegated Act 2017/654 to accept the compliance with UN Regulations 49 (06 series of amendments) and 96 (05 series of amendments). Type-approvals according to these UN Regulations must be completed by in-service monitoring requirements provided in Regulation 2017/655
  • The situation in Turkey, where mobile machinery with Stage IIIA, Stage IIIB and Stage IV engines can be placed on the market till the end of the year; then, they will need to be fitted with a Stage V engine. In other cases, Stage V engine will be requested from 1 October 2022;
  • The situation in UK, as since 1 January 2021 (end of the transition period following the withdrawal of UK from the EU), the amendments published in the EU are no more automatically taken over in the UK law. For example, the implementation dates for transition vehicles with engine power between 56 kW and 130 kW have not been modified for the UK market.

This FAQ does not cover specific rules applying to agricultural and forestry tractors. In practice, the engine installation for such equipment is provided in Regulation (EU) 2018/985. Although the updated implementation dates for transition vehicles provided in Regulation 2016/1628 do impact tractors as well, an official amendment is expected for this month or March 2022.
